Is this a rental unit? Does it mention smoking in the agreement? Where is the garage in relation to the home? I really don't see how you can be prevented from smoking on a balcony- which is outdoors, after all!

Being allowed to smoke on the balcony would make sense, and being that he's in California would make anything that makes sense illegal.

I dont see how they could stop someone from smoking outside!
