A kick in the nuts due to new law....
 
Went by my favorite B&M today. First time I've been by there in a while due to moving and being busy. Went in, a few guys sitting around in the lounge area talking as usual. Didn't pay much attention to the fact that nobody was smoking. Went in the humidor, picked out a Padron, went to the counter. Shop owner rang me up and started to bag the cigar. I said "Don't worry bout that, gonna smoke it here". Then he broke the news.....no more smoking in the shop due to that new smoking ban that just came into affect in North Carolina. I thought that only applied to the bars and restaurants! We talked about it for a couple minutes and he said the reason it affected him was the fact of his shop being in a strip mall setting. The neighbors have been complaining to the landlord and all. It was a kick in the nuts because thats the only place around I knew to smoke in. Anyway, I enjoyed my cigar on the ride back home, so not a complete loss! He said he was working on a solution....guess he may be planning on moving to a free standing building so smoking will be allowed. I really hope he does because the owner is an awesome guy and he runs the best B&M around here. I'll continue to go there for B&M purchases, just a shame that the days on sitting around in there enjoying a good smoke are gone.

Oh that sounds terrible. ive been looking for a place to smoke at because during the winter here it gets too cold to just go out on the deck or to the garage unless i get a fire goin in there, which i dont always feel like going through the hassle for. hopefully he moves to a place where the lounge can be of use again.

I would be and am all in favor of no smoking in a restaurant. But laws have taken the ban to a level of stupidity that boggles the mind.

I really think this decision should have been left up to the individual property owners. I guess I could go along with the restaurants being completely smoke free in some cases. Mostly because of so many inconsiderate cigarette smokers.....alot of them have no standards and even tend to light up in a non smoking section. As far as a bar goes....give me a break! I've read all these comments on these news site "I hate smelling like a bar when I get home". Well....how about not going to a bar if you don't want to smell like one! It is what it is! Go to McDonalds eat inside, you'll likely smell like french fries when you come out. I think bars, and businesses not serving food should not have been affected.

Yep. A b&m has to be in a free-standing building with no other stores joining it. A no smoking b&m is more common than most think. This new law was passed back in June.

After trying a Kerosene Heater and salamander type. I found this to be fast heating and it runs up to two weeks on a tank.
That's with going out most every evening for a two or three hours.
Normally I only use one side.

Make sure you have good ventilation!

It happens when people don't pay attention to what their fascist gubment is doing to them. This state has been in trouble for a while. I can't tell you how many people I have spoken with in the past few days that knew nothing of the new law.

Matter of fact I went looking for one of these today. They want over $100.00 here for them. I'll get one sooner or later.

I use one of these in the house and in the garage in the winter. Works great and have used it for the last 3 years. The cost to use this per hour is 11 cents at 1500 watts.

I was under the impression that the NC smoking ban specifically said that tobacco shops were exempt from the ban. :confused:

Get this, I go to a place called CDO Smokers Lounge. I go in the joint and guess what, theres not even a smoking lounge! :mad: how much more misleading can you be lol

That's what I'm using, works great. Lowes has them for around eighty bucks.

I live in North Carolian also, no problem at my B&M, and he's in a strip mall. I agree with you, his fellow tenants should not have been able to stop him from allowing you guys to smoke in the shop.

The Salsa Place LOVES the business we bring him...I still remember the Pepin event when that guy reeking of the 3 week old jockstrap said the smoke was "bothering him"...come to think of it....I haven't seen him lately....:r

Actually since the new owner bought the place there haven't been any problems.

Exactly how I stand on it. I don't think smoking should be okay in restaurants unless you are sitting outside on a porch/patio and there are no kids around. A bar, is a place where people get drunk and wild anyways, so why not smoke? You don't bring your damn kids to a bar. If you don't want to be around smoke, don't go to a bar. And to impose these laws on businesses that rely on tobacco sale and allowing their customers to stay and smoke/drink/hang out is ridiculous and detrimental to tons of B&Ms.

I remember when this one passed. I thought a business could pay a $200 fine and not worry about it for a while.

No offense to any of you yankees here at CA (I love you all, even the Massholes), but NC has had way too many carpetbaggers move into this state over the past two decades. They brought the no-smoking and other legislation with them.

There are two different types of propane heaters sold, vent free, and those that need to have good ventilation.

There are some pretty good vent free setups that would work great in your garage. Here is a good example of one

I just pick up one of these a couple of days ago, works good for knocking the cold off. I have one of the parabolic dish that I let run most of the night and use the Heater Buddy to compensate in between. As with any thing with a open flame you need a little ventilation.The Heater Buddy states on the box safe for indoor use, instructions say to crack a window. If this helps my garage is 20x20 with 12' ceiling and I'm in a t shirt @ 28* outside

Hmmm, wonder how that will effect one of Tinder Boxes flagship stores for the Charlotte area, which is in the Southpark Mall.
I went to a bar last night for the fight and felt like I was back in NY. No cigarette smell and you could see clear across to the other side of the bar. I did chuckle when the heat kicked on because you could than smell the smoke that was in the system from before the ban. Not too many bars let you smoke cigars in them but I knew of a couple and will miss it. One bar in Gastonia would even let a group of us hang out and smoke for hours on end. It's too bad the ban passed. When I moved here almost three years ago I thought for sure this would be one of the last states that would impose a smoking ban. Like most other things in life, I guess I was wrong.

Having never been able to smoke in a b&m here I can't imagine what the feeling of having that chance taken away would be. Kick in the nuts probably sums it up pretty well.

And I agree that this ban stinks. I rarely ever smoke at dinner, but would love to enjoy a cigar and scotch in a bar on occasion. Shame that cannot happen in NC.

The Pipe & Pint in Greensboro. I haven't found an actual "Tobacconist" in Winston-Salem, much less any sort of lounge. Just a few smoke shops that carry some cigars. Only B&M's in Winston I've ever purchased from are Tobacco Leaf over near Jonestown Rd. and Pipes Etc. at Thruway Plaza. I live down off of Hickory Tree Rd., there is a small smoke shop about 2 minutes from the house called R&R Tobacco & News. They carry a decent assortment of premium cigars.

This is the same thing that happened in Oregon 1/1/2009. A new statewide law (ban, really) went into effect:
  • No smoking withing 10 feet of any door or window of a public establishment. If someone smokes within 10 feet of a business, and someone else complains, the business owner is fined. Ridiculous! Why should a business owner be required to police the public property outside their doors??
  • No smoking anything other than cigars at existing cigar bars
  • No new cigar bars - Only cigar bars with established cigar-related revenues in 2006 can be cigar bars after 1/1/2009 -- lots of places closed due to this
  • Only 40 people allowed in a cigar bar (regardless of actual capacity). This caused several cigar bars to stop allowing cigars due to the loss of revenue
  • Ad infinitum
One of the major justifications for this is "employee safety" -- employees required to work in an unsafe (second-hand-smoke environment). If you don't like working in a smoky room, get a job elsewhere...

The Oregon Bar Owners association has complained to the legislature because their business is off 29%. The Oregon Lottery revenue from Video Poker is down 20%. Several of the B&M cigar stores are no longer able to allow smoking so their revenue is off... (have to be a free-standing building, ventilation requirements, etc. that most B&Ms cannot meet -- particularly the free-standing building requirement).

What ever happened to people voting with their feet/dollars? If you don't like a restaurant or business due to smoking or non-smoking requirements, you take your business elsewhere.

I used to have a choice of at least a dozen cigar-friendly places to eat or drink within a reasonable drive. Now I have two in the winter and a third in the summer.

Like many others, I went out and got propane heaters for my deck, so as long as it is not too windy or wet, I can smoke out there. If it is windy or wet I can smoke in the garage, but I have to be careful about smoke getting into the house from the furnace intake...

I LIKE the Pipe & Pint. Sorry to hear that they cannot smoke there anymore. Actually purchased my first ever box of cigars there. Torano Exodus 1959 Gold. Yummy.

The Tinderbox has reopened in Hanes Mall. The owner (Bobby) has a pretty good selection, but he charges too much usually.

Had my last cigar at the Tap Room in Hickory NC last week, used to love going there for a pint of Guinness in my pewter mug and a good cigar

Well, at least I am moving to Ft Jackson SC for the next three months for training, found a place off post called Light em up Cigars. Plan to enjoy that before moving to Schofield Barracks Hawaii in April where I have heard there is no smoking there either

Not exactly.

Individuals will be fined $50.

Businesess:
First violation. – Provide the person in violation with written notice of the person's first violation and notification of action to be taken in the event of subsequent violations.
Second violation. – Provide the person in violation with written notice of the person's second violation and notification of administrative penalties to be imposed for subsequent violations.
Subsequent violations. – Impose on the person in violation an administrative penalty of not more than two hundred dollars ($200.00) for the third and subsequent violations.

(a) Notwithstanding g Article 64 of Chapter 143 of the General Statutes, smoking is prohibited in all enclosed areas of restaurants and bars, except as provided in subsection (b) of this section.

(b) Smoking may be permitted in the following places:
(1) A designated smoking guest room in a lodging establishment. No greater than twenty percent (20%) of a lodging establishment's guest rooms may be designated smoking guest rooms.
(2) A cigar bar if smoke from the cigar bar does not migrate into an enclosed area where smoking is prohibited pursuant to this Article. A cigar bar that begins operation after July 1, 2009, may only allow smoking if it is located in a freestanding structure occupied solely by the cigar bar and smoke from the cigar bar does not migrate into an enclosed area where smoking is prohibited pursuant to this Article. To qualify under this subsection, the cigar bar must satisfactorily report on a quarterly basis to the Department, on a form prescribed by the Department, the revenue generated from the sale of alcoholic beverages and cigars as a percentage of quarterly gross revenue. The Department shall determine whether any additional documentation is required of the cigar bar to authenticate or verify revenue data submitted by the cigar bar. This subdivision shall not apply to any business that is established for the purpose of avoiding compliance with this Article.
(3) A private club...............................

(3) A tobacco shop if smoke from the business does not migrate into an enclosed area where smoking is prohibited pursuant to this Article. If the neighbors don't complain, everything is good when in a strip mall. But it will only take a couple of complaints then they will be screwed. So any smoke nazi can complain and "win" even if there is no real bleed over of smoke.

You need to stop typing right now! You're making too much sense!

No smoking in a B&M is a damn shame,. I've become accustomed to smoking bans and realize they are likely a permanent fixture for the future, but Tobacco shops? Really? After a few complaints? What's happening in NC?

That sucks, but makes a lot more sense than what I thought was a one time $200 fee.
