This is the same release that registered iPhone developers have had access to for a while now. As to legality, it's a piece of software which has always been available for free running on a device you already own, I fail to see any legal issues there. Besides, the public release is in 6 days so you can always just wait for the full Apple rollout (like those of us on Windows have to anyways).

Pre-order day tomorrow! This will be my first iPhone - I've waited 3 years for a Verizon iPhone and I just can't tolerate my Blackberry any longer. Looking forward to the cool cigar apps that are out there.

yeah ... in the US it's a violation of copyright law to obtain it in the manner suggested in the link posted earlier. developers may have access; but all y'all ain't developers. also, I didn't say iOS4 was beta. I realize it's the "golden master" version. the iTunes version is beta, however.

my wife and I are in the same boat re: the BB. we liked them at first; but we're ready for our iPhones. :D

So what if iTunes is beta? Most Windows software is alpha at best. :p I'd still rather run beta iTunes than that crap.

Wasn't trying to be combative. Just stating that the legal issues are probably not all that significant given the circumstances. The people that Apple would likely go after, if anyone, would be the developers who (presumably) violated the terms of their license agreement by making the beta version of iTunes available to the public.

Argh!!! It won't take my order on the web and Apples phone system is down. ATT has a 7-10 minute wait and I have gotten cut off twice after almost 6 minutes!! Very un-Applelike.

Yeah ... you lucked out. Seems to basically be rolling blackouts on the Apple website. Epic fail. The ATT Premier site is up an running with the iP4 finally showing. I think I'll order it from there (though I wanted to order a bumper along with it).

Edit: Looks like the Apple Store is back online for me. Hmmmm....

Yeah ... it's dog slow. So's ATT's site. If you think about it, demand is probably higher for this one than any previous release. The 3GS was pretty high; but a lot of 3G owners didn't upgrade. So today we're looking at 3G folks upgrading, a lot of 3GS folks upgrading, plus a ton of new customers. I bet you anything this is the biggest launch for a smartphone. Ever.

Yeah I'd say your right. I finally gave up on the Apple site and went to the ATT site and it's doing the same thing. I'll probably wait until tomorrow or later this evening till it slows down a bit.

Maybe it wouldn't let you order because you did not fax them a permission letter from your wife. :r If you look at the very bottom of the page it has a statement. I have cut and pasted it below for you:

Just curious about the old iPhone. Can it still be used to play music/movies without being used as a phone?
I haven't tried ordering after reading the comments here. Plus my wife wants a white one.

For such a hyped launch, it's pretty amazing that they're failing so miserably this morning. I wonder how many millions of hours of productivity are being lost across the country right now as people keep trying to get the site to work. I know most folks in my office haven't gotten jack for work done yet. :r

It is amazing.

I have wasted quite a bit myself.
Tried Apple.
Tried AT&T.
Both are locked up and literally crashed.

Tried calling them for kicks.
Neither can take the call due to volume.

I guess there is not much interest in Apple's new phone at all.

not sure why, but I don't seem to be having much of a problem since the site went live. I do have dsl 6.0 , but I'm sure others have connections that are just as fast.
Also Apple release an Apple store iPhone app today. They said u could download the app and upgrade from ur iPhone

Man that was a bad choice ;) I preordered my 32gb iPad for pickup. Stood in line for *3* hours to get it. They'd only let 5 people in the store at a time.

The site seems to be much faster now but I keep getting errored out on the check eligibility page - dang guess I shouldn't have maxed out all my credit cards on cigars and bourbon!! :)

Can anyone add some light to this statement on Apple? They show a different price if for an upgrade.

Requires new two-year AT&T wireless service contract, sold separately to qualified customers; credit check required; must be 18 or older. Existing AT&T customers who want to upgrade from another phone or replace an existing iPhone will find out if they are eligible for early upgrade pricing: $299 (8GB), $399 (16GB), or $499 (32GB) with a new two-year contract. For those who are not eligible for an early upgrade, the prices are $499 (8GB), $599 (16GB), or $699 (32GB). In CA, MA, and RI, sales tax is collected on the unbundled price of iPhone.

I downloaded the app. (searched apple from iphone)
You can only reserve for pickup. I'd rather have them deliver it.
I'll need to sync it with itunes anyways.

Yeah I went to the Apple store last night about 1am Pacific time, 4am Eastern time to see if I could beat the rush since I'm on the west coast, but the store wasn't even up. Said they were upgrading the system... Now I've been trying for an hour with no luck. Even called AT&T and they said I need to preorder online only... thanks!?! LOL

Regarding the Apple App to preorder... great idea but for me, only if they allowed shipping. I don't want to deal with waiting in lines and can wait a day or two for shipping if needed.

also I went with the unlimited data for $30 vs 2G for $25.

Was at the local ATT store since 930am and the ATT ordering system is down. Had to have them call me and do it over the phone.

Imagine a world (well, an America) where the iPhone was spread across multiple carriers and instead of bogging down one carrier's site on launch day, it was spread across 4 different carriers. We all ordered our new iPhone's in a timely fashion and actually got some work done...it seems too good to ever be true.

I finally got mine pre-ordered on the ATT site!! One thing I hate though is that Apple requires FedEx to get a signature for delivery. I may have to pay someone to sit at the house all day on the 24th!!

Once you get the tracking number on the shipment, you can call FedEx and ask them to hold at the depot or re-route to a Kinkos/FedEx Office near you and you can pick it up there.

I don't blame Apple for being a PITA on the shipping with mandatory signature requirements, these things are going to be a very hot item for theft.
