I own/ed an 09 Outback Sport for about a month and had less then 3k miles on it. Tonight I totaled her. I hit a guard rail goin around a sharp turn and ripped off the whole front passenger wheel assembly (shock, brakes, axle...everything) , front bumber/grill and the passenger quarter panel. 3 air bags deployed, the steering, and both passenger curtain bags blew. Im totally fine but Im pretty sure shes totaled.


Oh and the police officer gave me a failure to keep right ticket....I crashed on the right side lol

Thanks yeah I almost had to Jeff Gordon myself out and Im also thinkin of fighting the ticket but Im also worried the judge would throw it out and give me a careless driving. Can they do that?

I havent talked to insurance yet but just by lookin at it I can saw Im 99% sure it will be. My friends and I were thinkin just buy a new subaru and maybe transfer the loan over (Ive only made 1 payment) and use the money I get from the car to put down on the new one. Idk what do u guys think?

I would deffinatly argue the ticket, don't foreget your pictures if you go to court. Also if you don't mind me asking, what was the cause of the accident? Just going too fast?

going too fast but I was down shifting and breaking but the way the road is. It has like a little hump and what I think happened was the cars weight shifted all onto the front passenger tire and the tire couldnt take the deceleration and momentum and it just let loose.

Not sure if the judge can do that. Up here if one fights a ticket they see a magistrate. The magistrate can only ammend the ticket for less than what the police wrote other than if the po-po at least in my experiance such as a speeding ticket writes it for less and the drive was an idiot and is an idiot in court. Then sometimes I request the ticket be ammended to the full amout of speed I caught them at. I know, I'm a A$$ sometimes :D

Andrew is right....here, the prosecutor can ask to amend the ticket to the proper violation, but the judge can't do it of his own volition. Being that it was a one-car crash, they might just let it go.

:tpd:(Tom's not stupid though) I agree and being as you might be worried over a careless ticket that is a civil infraction up here so no prosecutor invovled.

Better talk with your auto insurance agent first. Your rates might take an even bigger hike if you are convicted of a moving violation.

What did you tell the police? I mean there was a deer that ran out in front of me so I slammed on the brakes and ended up in the guard rail. :D

I told them I was doing 40-45. I had no real clue how fast I was actually goin. I was just downshifting and breaking as fast as I could and I figured thats probably what I was doin at the time of impact.

Careless driving is viewed as a pretty big deal, at least in Detroit! LOL! I've slowed down a lot in my older years, but when I was younger I accumulated three of those violations in a 7 year period.

In 2000, I totaled my 66 conv. Mustang by driving straight into a telephone pole at 45mph. I swerved off the road to avoid another driver and didn't have enough time to correct. Got bruised up a bit, but no injuries. Only had a lap belt.
Basically, the police told me I should have let the guy hit me, as now it is a 1 car accident. They were nice though and didn't give me any tickets.

Yeah it was over on wykertown road by the 2 sharp turns by the hay farm. If u happen to drive thru there you'll probably see the smashed guard rail

As far as the ticket, do yourself a favor and talk to a lawyer in NJ. If you have your insurance through an agent and are friendly with him, ask him about what it will do to your rates. If you are with a bigger co, don't ever mention a moving violation to them. They will already jack your rates through the roof for totaling a brand new car - single-car accident = your fault.

That might just cause more problems (i.e., perjury) if the cop who investigated the crash saw that there were no flat tires on the vehicle. ;)

That is a mess. Again, when it comes to safety, Subarus are top of the line. I hope it all works out for you.

I see accidents all the time driving home, I live in BFE, windy roads and an allowed faster speed limit, causes some people to become less than stellar drivers. So far I have not had to assist in anything that caused too much injury to those involved. I have seen crashes that were the result of a blowout, it can throw the car right off the road.

It is a pretty fun car to drive and pretty quick most of the time. The only thing I dont really like about it is the rear suspension. The front feels tight and all but the rear just feels light and there is a good amount of body roll for a car like that. Now the WRX is probably alot more agile and fun to drive. If my insurance wasnt goin to kill me in July I would have gotten one but for now Im just slowly upgrading the suspension
